These Terms & Conditions ("Terms") govern your access to and use of the FamiVault and FamiVault Link mobile applications (together, the "Apps" or "Service"), the website at localfamilyvault.com (the "Website"), and all related services provided by Local Family Vault ("we", "us", or "our"). By downloading, installing, or using the Apps in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not install or use the Apps.

⚠️ Critical Notice — Please Read First
FamiVault and FamiVault Link are built on a privacy-first, end-to-end encrypted architecture. All vault data is encrypted on your device using keys that only you control. We do not have access to your encryption keys or passwords. Even when encrypted data passes through our relay servers (FamiVault Link only), we cannot read or reconstruct your files. This means:
If you lose your device, forget your password, or delete the App, we cannot recover your data under any circumstances. Maintaining regular backups using the in-app Backup Vault feature is your sole responsibility.
1. Description of the Service
FamiVault is a strictly offline, device-local encrypted vault application for securely storing critical family documents (e.g., identity documents, insurance records, wills, passwords, and medical information). All data is encrypted using AES-256 directly on your device and is never transmitted to, or stored on, any external server.
FamiVault Link extends this with the ability to securely sync encrypted vault data with trusted family members' devices via an end-to-end encrypted cloud relay. Your files are encrypted on your device first, and only the encrypted data is transmitted through our relay servers. This encrypted data is held on the relay temporarily for the duration needed to complete the transfer and is automatically purged once delivery is confirmed. No permanent copy of your data is ever stored on our servers. We do not possess the decryption keys and cannot read your data at any point.
2. Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained verifiable parental or guardian consent as required by applicable law in your jurisdiction. By using the Service, you represent that you meet these requirements. We reserve the right to terminate accounts of users discovered to be under 13 without prior notice.
3. Account Security & Password Responsibility
The Service operates without a centralised account system. Access to your vault is governed entirely by the password and/or biometric lock you configure on your device. You are fully and solely responsible for:
- Choosing a strong, unique vault password that you can remember or store securely.
- Keeping your vault password confidential and not sharing it with unauthorised persons.
- Storing your vault password in a trusted password manager or secure written record.
- Making regular use of the in-app Backup Vault feature to transfer an encrypted copy of your vault to a trusted family member's device.
We have no ability to reset, retrieve, or provide hints for your vault password. If your password is lost, your vault data is irrecoverable. This is a deliberate security feature, not a limitation.
Accounts registered by bots or any other automated methods are not permitted.
4. User Responsibilities & Prohibited Conduct
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:
- Use the Service to store, share, or distribute any content that is unlawful, defamatory, obscene, fraudulent, or infringes any third party's intellectual property or privacy rights.
- Attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Apps.
- Store files or personal data belonging to another individual without their explicit, informed consent.
- Use the Service to facilitate any criminal activity, money laundering, fraud, or harassment.
- Attempt to probe, scan, test, or exploit any vulnerability of the Service or associated infrastructure.
- Interfere with or disrupt the integrity or performance of the Service or our relay infrastructure.
- Use any automated means (bots, scrapers) to access or interact with the Service.
- Re-sell, sublicense, rent, or otherwise transfer the Service to any third party without our express written consent.
We reserve the right to terminate your access immediately and without notice if we reasonably believe you have violated any of the above.
5. Your Content & Data
You retain full ownership of all files, images, documents, and data you store within the Apps ("Your Content"). Your data is encrypted on your device using keys that only you control. We do not hold or have access to your encryption keys. Even when encrypted data temporarily passes through our cloud relay (FamiVault Link only), we cannot access, review, decrypt, monitor, or use Your Content in any manner.
By using the Service, you represent and warrant that:
- You own, or have all necessary rights and licences to, all content you store in the vault.
- Your Content does not violate any applicable law or regulation, or infringe any third-party rights.
- You understand the Service is not a substitute for professional legal, financial, or medical advice, and we accept no liability for decisions made based on content stored in the vault.
6. Subscriptions & Payments
The Apps may offer optional paid subscriptions. The following terms govern subscriptions:
- Billing: All subscriptions are billed exclusively through the Apple App Store or Google Play Store. Your payment details are held by Apple or Google, not by us.
- Currency: Website prices are shown in US dollars unless otherwise stated. The App Store or Google Play checkout may display localized currency, tax, and final pricing according to your account, location, and store rules.
- Auto-Renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period through your App Store account settings.
- Cancellation: You may cancel at any time. Cancellation takes effect at the end of the current paid period. We do not provide partial refunds for unused time, except as required by applicable consumer law.
- Price Changes: We may update subscription pricing with reasonable advance notice. Continuing to use the Service after a price change is effective constitutes your acceptance of the new price.
- Receipt Validation: We use RevenueCat solely for anonymous subscription receipt validation. We do not store or process any of your payment credentials.
- USB Drive Requests: A dedicated physical USB drive may be available to eligible subscribers. It is not sold as a standalone physical product. Standard worldwide shipping may be provided where supported, but you may be responsible for customs charges, import duties, local taxes, and failed-delivery costs caused by an incorrect address, refusal, or local delivery rules.
- Refunds: All refund requests must be directed to Apple or Google in accordance with their respective refund policies. We have no authority to issue App Store or Play Store refunds.
7. Data Backup & Risk of Loss
Because data is stored on your local device, it is inherently vulnerable to events entirely outside our control. Data loss may occur due to, but is not limited to:
- Device loss, theft, damage, or destruction
- Accidental deletion of the App (which will permanently destroy the encrypted vault)
- Mobile operating system updates that may corrupt local application storage
- Hardware failure or manufacturing defects
- Factory reset of the device
We strongly urge all users to regularly use the Backup Vault feature, which creates a password-protected encrypted export of your entire vault that can be transferred to and stored on a trusted family member's device or a secure external storage location. Failure to maintain adequate backups is entirely at your own risk and we accept no liability for any resulting data loss.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOCAL FAMILY VAULT, ITS FOUNDERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
— Loss of, corruption of, or inability to access vault data or files
— Loss of a forgotten vault password or biometric credential
— Unauthorised access to your device, vault, or encrypted data by a third party
— Business interruption, financial loss, or reputational harm
— Loss of profits, revenue, goodwill, or anticipated savings
— Any loss or damage arising from your reliance on the Service
OUR TOTAL AGGREGATE LIABILITY TO YOU ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL SUBSCRIPTION FEES PAID BY YOU IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
CERTAIN JURISDICTIONS DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN TYPES OF DAMAGES. IF YOU RESIDE IN SUCH A JURISDICTION, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY MANDATORY LOCAL LAW.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, whether express, implied, statutory, or otherwise. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
- Any warranty that the Service will be uninterrupted, timely, secure, or error-free.
- Any warranty that defects in the Service will be corrected.
- Any warranty that the Service or the servers that make it available are free of viruses, malware, or other harmful components.
- Any warranty that your data will not be lost, corrupted, or become inaccessible.
10. Intellectual Property
The Service, including all App code, UI design, branding, trademarks, trade names, logos, and original content, are and shall remain the exclusive property of Local Family Vault and its licensors. Nothing in these Terms shall be construed to grant you any rights in Local Family Vault's intellectual property other than the limited personal licence described below.
Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the Apps solely on your own personal mobile device(s) for your own private, non-commercial purposes. You may not copy, modify, distribute, sell, or sublicense any part of the Service.
11. Third-Party Services
The Service integrates with or relies upon the following third-party services:
- Apple App Store / Google Play Store — for app distribution, installation, and subscription billing.
- RevenueCat — for anonymous subscription receipt validation only.
- Firebase (FamiVault Link only) — used for anonymous authentication to enable the encrypted cloud relay for sync. No personally identifiable information is stored.
We are not responsible for the availability, content, accuracy, or privacy practices of any third-party service. All third-party use is governed by their respective terms and privacy policies.
12. Termination & Service Interruption
We may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your licence to use the Apps ceases immediately. Because your vault data is stored locally on your own device, any existing locally stored data remains on your device independent of any termination by us.
To ensure the best possible Service level, we reserve the right to interrupt the Service for maintenance, system updates, or any other changes. Within the limits of law, we may also decide to suspend or discontinue the Service altogether.
⚠️ DELETION WARNING
You may terminate your use of the Service at any time by uninstalling the Apps. Note that uninstalling the Apps will permanently destroy your locally encrypted vault unless you have made a Backup Vault in advance. Please use the Backup Vault feature to transfer all User Content securely before you delete the mobile application, because the mobile application will not provide this Service to you automatically.
13. Indemnification
You agree to defend, indemnify, and hold Local Family Vault, its founders, affiliates, officers, directors, agents, partners, suppliers, and employees harmless from and against any and all claims, demands, damages, obligations, losses, liabilities, costs, or debt, and expenses (including, but not limited to, legal fees) arising from:
- Your use of and access to the Service, including any data or content transmitted or received by you.
- Your violation of these Terms, including but not limited to your breach of any of the representations and warranties.
- Your violation of any third-party rights, including but not limited to any right of privacy or intellectual property rights.
- Any content that is submitted from your device or vault, including misleading, false, or inaccurate information.
14. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. Any legal action or proceeding arising from these Terms or your use of the Service shall be brought exclusively in the competent courts of New South Wales, Australia, and you hereby irrevocably consent to that jurisdiction.
Before initiating any formal legal action, you agree to contact us first at info@localfamilyvault.com and give us 30 days to attempt to resolve the dispute informally. Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief.
15. Changes to These Terms
We reserve the right to modify these Terms at any time at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page and, where feasible, notify you through an in-app notice. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
